The Chase Village Bikeathon Prize Draw Terms and Conditions
By entering this Promotion, you are agreeing to be bound by these terms and conditions.
1. The Promoter
The promoter is J.P. Morgan Europe Limited trading as Chase of 25 Bank Street, Canary Wharf, London, E14 5JP, United Kingdom (“Promoter”).
2.1 The Promotion is only open to:
(a) individuals aged 12 or over; who have a booking and attend the Chase Village at the Commonwealth Games 2022, Smithfield, Birmingham on one of the following dates/times (the “Experience”):
- Friday 29th July: 14:00–21:30
- Saturday 30th July: 13:00–21:30
- Sunday 31st July: 13:00–21:30
- Monday 1st Aug: 13:00–21:30
- Tuesday 2nd Aug: 13:00–21:30
- Wednesday 3rd Aug: 13:00–21:30
- Thursday 4th Aug: 13:00–21:30
- Friday 5th Aug: 11:00–20:00
- Saturday 6th Aug: 13:30–21:30
- Sunday 7th Aug: 13:30–21:30
(each a “Participant” and together theParticipants”).
2.2 Bookings for the Experience must be made by someone aged 16 or over if for themselves, or 18 or over if for someone between the ages of 12 and 15 (each a “Booker”).
2.3 The last booking available for the Experience on each of the above mentioned dates will be 5 minutes prior to the closing time.
2.4 Individuals between the ages of 12 and 15 must be accompanied by a parent or guardian aged 18 or over to attend the Experience, participate in the Promotion and claim a Prize or Gift (as defined below). The Promoter may ask winners and guardians to provide proof of age.
2.5 Each booking for the Experience is limited to 9 people and the same individuals cannot book or attend the Experience more than once.
2.6 The Promoter reserves the right to refuse entry to anyone it believes to be under 12 years of age.
2.7 In entering the Promotion, you confirm that you are eligible to do so and eligible to claim the Prize or Gift (as defined below). The Promoter may require you to provide proof that you are eligible to enter the Promotion.
2.8 The Promoter will not accept Promotion entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with;
(d) photocopies and not originals; or
2.9 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize Promotion.
3. How to enter
3.1 The Promotion will run between 29 July 2022 and 7 August 2022 inclusive (“Promotional Period”).
3.2 To enter the Promotion:
(a) you must have valid a booking to attend the Experience; and then
(b) attend the Experience during your booked slot; and then
(c) cycle on the bike for 90 seconds (the “Bikeathon”)
(each an “Entry” and together the “Entries”).
3.3 There is a limit of one Entry per person. Joint submissions are not allowed.
3.4 No purchase necessary and there is no charge to enter this Promotion.
3.5 The Promoter willnotaccept:
(a) responsibility for Promotion entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of posting or transmission as proof of receipt of Entry to the Promotion.
4. The prizes and gifts
4.1 The prizes are:
(a) £200 Lifestyle gift card (“Lifestyle Card”);
(b) £50 Birmingham Bullring & Grand Central gift cards (“Bullring Card”)
(each a “Prize” and together the “Prizes”).
4.2 There will 5 Lifestyle Card available to be won during the Promotional Period.
4.3 There will be 8 Bullring Cards to be wonper dayduring the Promotional Period.
4.4 All Entrants who do not win a Prize will receive a Chase and Commonwealth Games pin badge (each a “Gift” and together the “Gifts”).
4.5 The Promoter reserves the right to substitute a Prize or Gift with something of equal or greater value.
4.6 Prizes and Gifts are not negotiable or transferable by the winner. Prizes and Gifts must not be auctioned or resold. In the event the Promoter becomes aware that any Prize or Gift has been auctioned or resold, the Promoter reserves the right to withdraw the Prize from the individual.
4.7 The Bullring & Grand Central Gift Card Terms and Conditions will apply to the Bullring Card (see https://bullring.boxxed.com/Pages/Faqs (Opens in new window)) with the exception of the gift card expiry dates which shall be 15 November 2022.
4.8 The Lifestyle Gift Card Terms and Conditions will apply to the Lifestyle Card (see www.thelifestylevoucher.co.uk/terms (Opens in new window)), with the exception of the gift card expiry dates which shall be 29 December 2023.
5.1 All Prizes will be allocated at random.
5.2 After a valid Entry has been submitted, the Participant will receive a token which they will need to immediately insert into the random generator, as directed by a representative of the Promoter, in order for a Prize or Gift to be allocated to them at random (the “Draw”).
5.3 Immediately after the Draw, the Promoter will provide the winner with a Prize or Gift (as applicable). The parent or guardian of winners under the age of 16 will need to collect the Prize, if awarded. The Promoter cannot accept requests to receive particular Prizes. In the event a winner does not want to accept the Prize and/or doesn’t accept the Prize in accordance with this clause, a new winner will be able to win the Prize at random.
5.4 The Promoter does not accept any responsibility if you are not able to take up a Prize.
5.5 The decision of the Promoter is final and no correspondence or discussion will be entered into.
5.6 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the first and last name and county of prize winners to anyone who emails email@example.com within one month after the end of the Promotional Period.
5.7 If you object to your first and last name, county and winning entry being published or made available, please contact the Promoter firstname.lastname@example.org. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
6. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
7. Data protection
Prize winners agree to participate in promotional activity in relation to this Promotion which may include the publication of your name and photograph in any media.
9. Health & Safety
9.1 This Event is physically challenging and carries with it risks that we cannot entirely eliminate. These include the risk of personal injury. You should take care when participating and by participating in the Event, you confirm:
(a) you must act responsibly and sensibly at all times;
(b) you are fully aware of and accept the associated risks which include injury, damage to or loss of personal property;
(c) you will comply with all instructions given to them by any representative of the Promoter and use any equipment as directed and not so as to hurt or injure yourself or others;
(d) you are sufficiently fit and healthy to safely participate in the Bikeathon and do not suffer from any medical condition which would adversely affect your ability to safely participate; and
(e) you have not had recent surgery;
(f) you do not have heart issues/high blood pressure, neck or back problems, dizziness, fainting, seizures, motion sickness, epilepsy and/or any other health conditions that may be aggravated by this activity; and
(g) you are not pregnant or under the influence of alcohol or non-prescription drugs.
10.1 At all times throughout this Promotion, you must deal with the Promoter in the utmost good faith. The Promoter reserves the right to verify the eligibility of all Participants and disqualify anyone that it has grounds to believe has breached any of these terms and conditions or has acted dishonestly in relation to their participation in this Promotion.
10.2 The Promoter reserves the right to hold, void, suspend, cancel, or amend the prize Promotion, without prior notice.
10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
